Welcome to SomaPlay, a digital platform that offers educational and entertainment content including courses, performances, drama festival content, and other media. These Terms and Conditions (“Terms”) govern your access and use of SomaPlay (“the Platform”).

By accessing or using SomaPlay, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform.

 

1. Definitions

  • “Platform” / “SomaPlay” – The digital service providing educational and entertainment content.

  • “We,” “Us,” “Our” – SomaPlay.

  • “User,” “You,” “Your” – Any person accessing SomaPlay.

  • “Content” – Courses, videos, drama festival materials, articles, graphics, audio, or any materials provided on the Platform.

  • “Account” – The unique profile created for accessing SomaPlay services.

 

2. Eligibility

To use SomaPlay, you must:

  1. Be at least 18 years old, or have consent from a parent/guardian if under 18.

  2. Have legal capacity to enter a binding agreement.

  3. Use the Platform in accordance with Kenyan law and any applicable international guidelines.

 

3. Account Registration

  • You may be required to create an account to access certain features.

  • You must provide accurate and complete information.

  • You are responsible for maintaining the confidentiality of your login details.

  • We reserve the right to suspend or terminate accounts suspected of fraudulent or abusive activity.

 

4. Use of the Platform

You agree to:

  • Use SomaPlay only for lawful purposes.

  • Not copy, download, reproduce, or redistribute content except where expressly permitted.

  • Not interfere with or disrupt the Platform or its security systems.

  • Not upload harmful material including viruses, malware, or illegal content.

We may modify, update, or discontinue features without notice.

 

5. Content Ownership & Intellectual Property

  • All Content on SomaPlay is owned by Appranchise Limited, licensed creators, or third-party partners.

  • You receive a limited, non-exclusive, non-transferable license to access and view content for personal use.

  • You may not:

    • Reproduce, distribute, or publicly display content.

    • Use content for commercial purposes without written permission.

    • Remove copyright notices or digital rights management tools.

Any violation may result in legal action.

 

6. User-Generated Content

Where applicable (e.g., comments, uploads):

  • You retain full ownership of your content.

  • You grant us a worldwide, royalty-free license to display such content on SomaPlay.

  • You confirm that any uploaded material does not infringe third-party rights.

We reserve the right to remove inappropriate or illegal content.

 

7. Subscription, Payments & Fees

Where applicable:

  • Some content or features may require subscription or one-time payment.

  • Prices may vary based on user location, promotions, or partnerships.

  • Payments are processed through approved payment channels on the eCitizen platform or other designated systems.

  • All payments are non-refundable, unless required by law or stated in a specific refund policy.

 

8. Third-Party Services

SomaPlay may integrate with third-party tools, websites, or payment processors.
We are not responsible for:

  • Their content

  • Their policies

  • Their security practices

Your interaction with such third parties is at your own risk.

 

9. Data Protection & Privacy

We collect and process personal data in accordance with:

  • The Kenya Data Protection Act, 2019, and

  • Our Privacy Policy.

By using the Platform, you consent to the collection and processing of your data as described in our Privacy Policy.

 

10. Limitation of Liability

To the fullest extent permitted by law:

  • SomaPlay is provided “as is” and “as available”, without warranties of any kind.

  • We are not liable for:

    • Service interruptions

    • Loss of data

    • Technical errors

    • Unauthorized access to your account

    • Actions of third-party service providers

Our maximum liability to you shall not exceed the amount you have paid to us in the preceding 3 months, if any.

 

11. Indemnity

You agree to indemnify and hold harmless Appranchise Limited, XXX Limited, and our partners from any claims, damages, losses, or expenses arising from:

  • Your misuse of the Platform

  • Violation of these Terms

  • Violation of intellectual property rights

  • Uploading or sharing unlawful content

 

12. Termination

We may suspend or terminate your access without notice if:

  • You breach these Terms

  • You engage in fraud or illegal activities

  • We are required to do so by law or regulatory authority

Upon termination, your access to all content and features will cease.

 

13. Changes to Terms

We may update these Terms from time to time.
Changes take effect immediately upon posting on the Platform.
Continued use of SomaPlay constitutes acceptance of updated Terms.

 

14. Governing Law

These Terms shall be governed by and interpreted according to the laws of Kenya.
Any disputes shall be resolved in Kenyan courts or as otherwise agreed in writing.
